Please read these terms carefully. If you do not agree with any part of these terms, you should not use our services.
1. Definitions
In these Terms and Conditions:
- "We," "Us," "Our" refers to Tessaridge, a property rental service provider operating in Kuala Lumpur, Malaysia
- "You," "Your," "Tenant" refers to any person using our services or accessing our website
- "Services" refers to our property rental facilitation services, including property sourcing, viewing coordination, lease negotiation, and ongoing tenancy support
- "Property Owner" refers to the legal owner of the property being rented
- "Lease Agreement" refers to the rental contract between you and the Property Owner
- "Website" refers to our online presence at tessariidge.live
2. Acceptance of Terms
By using our services, you confirm that:
- You are at least 18 years of age and have the legal capacity to enter into binding agreements
- All information you provide to us is accurate, current, and complete
- You will comply with these Terms and Conditions and all applicable laws and regulations
- You understand that these terms constitute a legally binding agreement between you and Tessaridge
3. Description of Services
Tessaridge provides property rental facilitation services, which include:
- Initial consultation to understand your property requirements
- Property sourcing and selection based on your specified criteria
- Coordination of property viewings at mutually convenient times
- Property condition assessment and reporting
- Facilitation of lease negotiations between you and Property Owners
- Assistance with lease agreement documentation
- Coordination of utility setup and move-in logistics
- Ongoing tenancy support and maintenance coordination
We act as a facilitator between tenants and Property Owners. We do not own the properties and are not a party to the Lease Agreement between you and the Property Owner.
4. Your Responsibilities
Information Accuracy
You agree to provide accurate and complete information during the application process, including employment details, references, and identification documents. Provision of false information may result in termination of our services.
Property Viewing Conduct
During property viewings, you agree to treat the property and its contents with respect, adhere to scheduled viewing times, and conduct yourself in a professional manner.
Lease Agreement Compliance
Upon entering a Lease Agreement, you are responsible for complying with all terms specified in that agreement, including timely rent payment, property maintenance, and adherence to house rules.
Communication
You agree to maintain open communication with us regarding any issues, concerns, or changes to your tenancy requirements.
5. Fees and Payment Terms
Service Fees
Our service fees are typically paid by Property Owners. In some cases, administrative fees may apply to tenants for specific services. Any applicable fees will be clearly communicated to you in advance.
Rental Payments
Rental payments, deposits, and utilities are paid directly to Property Owners or their designated agents as specified in your Lease Agreement. We do not collect rent on behalf of Property Owners unless explicitly arranged.
Currency
All fees and rental amounts are quoted in Malaysian Ringgit (RM) unless otherwise specified.
6. Lease Agreements
Lease Agreements are contracts between you and Property Owners. While we facilitate the preparation and review of these agreements, we are not a party to them. Your rights and obligations are governed by:
- The specific terms outlined in your Lease Agreement
- Malaysian tenancy laws and regulations
- Any additional agreements made with the Property Owner
We recommend that you carefully review all lease terms before signing and seek legal advice if needed. We provide facilitation services but cannot provide legal advice.
7. Limitations and Disclaimers
Service Availability
We strive to provide accurate and current information about available properties. However, property availability can change rapidly, and we cannot guarantee that any specific property will remain available.
Property Condition
While we conduct property assessments, conditions may change between assessment and move-in. We encourage you to conduct a thorough inspection before signing a Lease Agreement.
Third-Party Actions
We are not responsible for the actions or omissions of Property Owners, building management, contractors, or other third parties involved in the rental process.
No Guarantees
We do not guarantee specific outcomes, including lease approval, rental rates, or property conditions. Our services are provided on an "as is" basis.
8. Limitation of Liability
To the fullest extent permitted by Malaysian law:
- Our liability for any claims arising from our services is limited to the amount of fees paid by you to us for those specific services
- We are not liable for indirect, consequential, or punitive damages
- We are not liable for disputes between you and Property Owners
- We are not liable for property damage, personal injury, or loss occurring during your tenancy
This limitation does not affect any statutory rights that cannot be excluded or limited by contract under Malaysian law.
9. Intellectual Property
All content on our website, including text, graphics, logos, and images, is owned by or licensed to Tessaridge and protected by intellectual property laws. You may not:
- Copy, modify, or distribute our content without written permission
- Use our trademarks or branding in any manner
- Scrape or systematically collect data from our website
10. Termination of Services
Either party may terminate our service relationship at any time:
- You may discontinue using our services at any time by notifying us
- We may terminate services if you breach these Terms and Conditions
- We may terminate services if you provide false information or engage in fraudulent activity
Termination of our services does not affect your existing Lease Agreement with a Property Owner, which remains in full force.
11. Dispute Resolution
Governing Law
These Terms and Conditions are governed by the laws of Malaysia.
Jurisdiction
Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
Informal Resolution
Before initiating formal proceedings, we encourage you to contact us to seek an informal resolution of any disputes.
12. General Provisions
Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Tessaridge regarding our services and supersede any prior agreements or understandings.
Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver
Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.
Assignment
You may not assign or transfer your rights under these terms without our written consent. We may assign our rights and obligations without restriction.
